Terms of Service
These Terms of Service ("Terms") govern your access to and use of seekers.shop (the "Site") and your purchase of products from SEEKERS LUXURY, S.L. ("Seekers", "we", "us"), a company incorporated in Spain, CIF B95897237, with registered office at Barrio Astola Nº18 Bajo 3 Izquierda, 48220 Abadiño (Bizkaia), Spain. Contact: support@seekers.shop.
By using the Site or placing an order you agree to these Terms. If you do not agree, please do not use the Site.
1. Eligibility and account
You must be at least 18 years old (or the age of majority where you live) to purchase from the Site. You are responsible for the accuracy of the information you provide and for keeping your account credentials secure.
2. Products and materials
We make reasonable efforts to display our products accurately, but colors and finishes may vary slightly depending on your screen. Details about the materials and finishes of each piece are provided on the product page and on our materials information page. Our jewelry is decorative fashion jewelry; finish names describe the color and appearance of each piece.
3. Orders, pricing, and payment
- All orders are subject to acceptance and availability. We may refuse or cancel an order for suspected fraud, pricing or stock errors, or violations of these Terms; if we cancel after payment, we will refund you in full.
- Prices are shown in the currency indicated at checkout and may change at any time; the price applicable to your order is the one shown when you place it.
- In the event of an obvious pricing error, we may cancel the affected order and refund you.
- Payment is processed by Shopify Payments and the payment providers offered at checkout. We do not store your full card details.
- Applicable taxes are calculated at checkout. For shipments outside the United States and the European Union, import duties may apply as described in our Shipping Policy.
4. Personalized and engraved items
Engraved or otherwise personalized pieces are made to your specifications. Review your personalization carefully before ordering: personalized items cannot be cancelled once engraving has begun and cannot be returned, except when they arrive damaged or defective or the personalization does not match your order confirmation. See our Refund & Returns Policy.
5. Shipping and returns
Shipping timelines, origins, and customs responsibilities are described in the Shipping Policy. Returns and refunds are governed by the Refund & Returns Policy (60-day returns) and, for EU/UK consumers, the statutory right of withdrawal described there.
6. Chargebacks and payment disputes
If you have any problem with your order, contact us first at support@seekers.shop; we resolve almost every issue faster than a card dispute. Initiating a chargeback for an order that was delivered as described, while simultaneously keeping the goods, may constitute abuse of the chargeback process. We reserve the right to dispute chargebacks with evidence of delivery and to refuse future orders from customers who abuse this process.
7. Intellectual property
The Site and all its content (designs, product photography, texts, logos, and the "Seekers" trademarks) are owned by or licensed to Seekers and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent, except for personal, non-commercial browsing and sharing with attribution on social media.
8. Reviews and user content
By submitting a review, photo, or other content, you grant Seekers a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content in connection with our products and marketing, with or without your handle. You represent that your content is your own honest opinion or creation, does not infringe third-party rights, and complies with applicable law. We may moderate content that is unlawful, offensive, or unrelated to the product, but we do not suppress reviews merely because they are negative.
9. Warranties
Seekers products are covered by our written One-Year Limited Warranty. For consumers in the United States: any implied warranties, including merchantability and fitness for a particular purpose, are limited in duration to the duration of that written warranty, to the extent permitted by law; some states do not allow such limitations, so they may not apply to you. For consumers in the European Union, the statutory conformity guarantee under EU law is unaffected. Except as expressly provided in these Terms and the Limited Warranty, the Site itself (content, availability) is provided "as is" without warranties of any kind.
10. Limitation of liability
To the maximum extent permitted by applicable law, Seekers' total liability for any claim arising from a purchase is limited to the amount you paid for the product giving rise to the claim, and we are not liable for indirect, incidental, or consequential damages. Nothing in these Terms limits liability for fraud, gross negligence, willful misconduct, personal injury caused by our negligence, or any liability that cannot be limited by law, and nothing limits your non-waivable rights as a consumer.
11. Disputes: talk to us first
Notice and cure. Before filing any claim, you agree to contact us at support@seekers.shop with a written description of the issue and give us 30 days to resolve it. Most issues are resolved within days.
Small claims. Either party may bring an individual claim in small claims court in the customer's county (or equivalent local court) instead of the process above.
Class action waiver. To the extent permitted by law, both parties agree that any proceeding will be conducted only on an individual basis and not as a class, consolidated, or representative action. If this waiver is found unenforceable for a particular claim, it is severable and the remainder of this section remains in effect.
12. Governing law
These Terms are governed by the laws of Spain. If you are a consumer, you additionally benefit from any mandatory protections of the law of your country or state of habitual residence, and you may bring proceedings in your local courts where the law gives you that right. For any dispute not subject to mandatory consumer venue rules, the courts of Bizkaia (Spain) shall have jurisdiction.
13. Prohibited uses
You may not use the Site to violate any law, infringe intellectual property, transmit malware, scrape or harvest data at scale, interfere with the Site's operation, or place fraudulent orders.
14. Changes to these Terms
We may update these Terms from time to time. The version in force when you place an order applies to that order. We will update the "Last updated" date and, for material changes, provide reasonable notice on the Site.
15. General
If any provision of these Terms is held invalid, the remainder remains in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights under these Terms; we may assign ours in connection with a merger or sale. These Terms, together with the policies they reference, are the entire agreement between you and Seekers regarding the Site.
